Terms & Conditions

These Terms & Conditions (“Agreement”) govern all bookings made with Destinato Travel and Tours. By paying any deposit or full payment, the Client (“You” or “Passenger”) acknowledges that you have read, understood, and agreed to be bound by these Terms & Conditions.

1. Booking and Payments

1.1 Deposit / Guarantee Payment

  • A deposit or guarantee payment is required to secure all bookings.
  • The required amount shall be based on the terms and conditions of the respective airline, hotel, cruise line, tour operator, or transport provider.
  • In certain cases—such as airline tickets, flash sales, or other promotions—full payment may be required immediately on a book-and-buy basis.
  • Unless otherwise specified, all deposits and guarantee payments are strictly non-refundable and non-transferable.

1.2 Balance Payment

  • The deadline for settlement of the remaining balance shall follow the payment terms of the relevant airline, hotel, cruise line, tour operator, or transport provider.
  • Destinato Travel and Tours will advise the Client of the applicable deadline in writing at the time of booking.
  • Failure to comply with the specified deadline may result in automatic cancellation of the reservation and forfeiture of all prior payments.

1.3 Prices and Surcharges

  • All prices quoted are based on prevailing rates at the time of booking.
  • Destinato Travel and Tours reserves the right to adjust published or confirmed prices in the event of currency fluctuations, changes in government taxes, surcharges imposed by suppliers, or other increases beyond its control.
  • If such increases amount to more than 10% of the package price, the Client may cancel the booking and request a refund of payments actually received by Destinato Travel and Tours, subject to supplier approval and refund policies.

2. Airline Bookings

2.1 Agency Role
Destinato Travel and Tours acts only as a booking agent for airlines. We do not own or operate any airline and therefore bear no responsibility for airline actions including, but not limited to:
• Schedule changes or delays
• Cancellations of flights
• Denied boarding due to overbooking
• Baggage loss, damage, or delays

2.2 Airline Rules
Airline policies on baggage allowance, check-in times, documentation requirements, flight changes, and cancellations apply in full and are binding upon the Client.

2.3 Name Changes
Airline tickets are strictly non-transferable. Name corrections, if permitted by the airline, are subject to their rules, fees, and penalties. Destinato Travel and Tours has no control over these charges and will not be responsible for any denied boarding due to incorrect passenger information.

2.4 Compensation
Any compensation, reimbursement, or remedies due to delays, cancellations, denied boarding, or baggage issues shall be the sole responsibility of the airline as mandated under the Air Passenger Bill of Rights (APBR) and Civil Aeronautics Board (CAB) regulations. Clients must claim such compensation directly from the airline. Destinato Travel and Tours shall not be liable for any additional compensation, claims, or demands—monetary or otherwise—by the Client beyond what the airline is legally obligated to provide.

2.5 Courtesy Assistance
Destinato Travel and Tours may assist the Client in coordinating claims or remedies with the airline, purely as a courtesy, and subject to the airline’s policies.

3. Hotels and Land Arrangements

3.1 Scope of Land Arrangements
Land arrangements may consist of accommodations, transfers, transport services (private or seat-in-coach), tours, activities, or any combination thereof. The exact inclusions are specified in the booking confirmation or voucher.

3.2 Accommodation Rules
Hotel bookings are subject to the rules and policies of the respective property. Room types, bedding, and special requests are not guaranteed and remain subject to availability.

3.3 Transfers and Transport Services

  • Transfers and transport services (private or seat-in-coach) are operated by local suppliers and are subject to their schedules, availability, and operating conditions.
  • Clients must be ready at the designated pickup point and time. Delays or missed services caused by the Client are non-refundable.

3.4 Tours and Activities

  • Tours and activities are operated by local providers. Destinato Travel and Tours acts only as an agent and is not liable for changes, omissions, or cancellations by local operators.
  • Unused services, whether voluntary (e.g., the Client choosing not to join) or involuntary (e.g., weather, local restrictions), are strictly non-refundable.

3.5 Service Inclusions
Only those services explicitly stated in the voucher or confirmation are included. Anything not listed (e.g., optional tours, extra meals, porterage, tips, incidentals) is excluded and must be shouldered by the Client.

3.6 Children’s Policy

  • Unless otherwise specified by the hotel or service provider, children may share existing beds with adults, subject to the property’s age and policy restrictions.
  • Requests for additional beds, cribs, or child seats are subject to availability and may incur additional charges payable directly to the supplier.
  • For transfers, tours, and other land services, children occupying a seat are generally charged, unless a supplier explicitly provides otherwise.
  • Parents or guardians are solely responsible for ensuring that all requirements for minors are met, including travel consent forms if a child is not accompanied by both parents, and any school or government clearances that may be required for travel.
  • Destinato Travel and Tours shall not be liable for any denied boarding, denied check-in, or forfeited services arising from incomplete documentation for minors.

3.7 Independent Airfare Bookings (DIY Flights)
When airline tickets are booked independently by the Client and not through Destinato Travel and Tours, Destinato Travel and Tours has no responsibility for missed tours, transfers, hotel stays, or other land arrangements resulting from flight delays, cancellations, offloading, or denied boarding. Any forfeited services are non-refundable. Destinato Travel and Tours has no obligation to reschedule or rebook affected services in such cases.

3.8 Special Requests

  • Destinato Travel and Tours will relay special requests (e.g., room preferences, tour add-ons, vehicle upgrades) to suppliers on behalf of Clients.
  • Such requests are not guaranteed and remain subject to supplier availability and discretion.
  • No refunds or compensation will be provided if a supplier is unable to accommodate special requests.

4. Collective Group Tours

4.1 Definition
Collective group tours are pre-packaged, fixed-departure tours inclusive of airfare, accommodations, transfers, and guided services, operated jointly with partner tour operators.

4.2 Ticket Issuance
Airline tickets for collective group tours are part of a group booking and may only be issued once all seats in the group are sold and confirmed by the operator. Clients acknowledge and accept this issuance process at the time of booking.

4.3 Group Itinerary
All participants must follow the group itinerary. Optional activities may be declined, but no refunds will be provided for unused services.

5. Shopping Stops

6.1 Certain itineraries include scheduled shopping stops as part of reduced package pricing.
6.2 Passengers are required to participate in these stops for the scheduled duration, as they form part of the contracted itinerary with local suppliers.
6.3 The Client is under no obligation to purchase any item during these stops.
6.4 Any decision to buy is made solely at the discretion of the Client. Destinato Travel and Tours shall not be liable for the quality, authenticity, pricing, or after-sales disputes of goods purchased.
6.5 Clients are advised to exercise due diligence when making purchases.

6. Visa Services

5.1 Agency Role
Destinato Travel and Tours assists Clients with visa applications by coordinating with embassies or their authorized processing centers. The outcome of any application is solely at the discretion of the embassy.

5.2 Documentation
Clients are responsible for providing complete and accurate documentation. Incomplete or fraudulent documents will result in forfeiture of all fees paid.

5.3 Passport Validity
All travelers must ensure their passport is valid for at least six (6) months beyond their intended travel dates or as required by the destination country.

5.4 Entry Types and Transit
Destinato Travel and Tours shall not be held liable for issues arising from visa types (e.g., single-entry vs. multiple-entry) or missing transit visas. It is the Client’s responsibility to secure the proper visa type for the itinerary.

5.5 Right to Decline Applications
Destinato Travel and Tours reserves the right to decline processing a visa application if, in its professional judgment, the Client’s documentation or personal profile does not reasonably support the likelihood of visa approval. This safeguard is intended to prevent the Client from incurring unnecessary costs and expectations where the chances of success are minimal. The Client acknowledges that such a decision is final and does not imply discrimination or prejudice.

7. Cancellations and Refunds

7.1 Written Notice
All cancellations must be made in writing. Verbal cancellations (phone, SMS, Messenger, etc.) are not valid.

7.2 Refund Eligibility
Payments made to Destinato Travel and Tours are non-refundable unless a refund is actually received from the airline, hotel, cruise line, tour operator, or transport provider.

7.3 Credits and Travel Funds
In cases where suppliers provide only credits or travel funds instead of cash refunds, Destinato Travel and Tours will pass these to the Client. Destinato Travel and Tours is under no obligation to convert credits/travel funds into cash.

7.4 Processing Time
Processing time for refunds or credits is solely dependent on suppliers and may take several weeks or months. Destinato Travel and Tours has no control over these timelines.

7.5 Strictly Non-Refundable Bookings
The Client acknowledges that certain bookings (e.g., promo fares, peak-season hotels, group tours) are strictly non-refundable and non-rebookable once confirmed.

7.6 Effect of Cancellation
Once a booking is canceled, all prior payments may be forfeited unless a supplier refund is secured. Destinato Travel and Tours bears no obligation to provide compensation beyond what is actually received from suppliers.

8. Passenger Behavior and Misconduct

8.1 General Conduct
Clients are expected to conduct themselves respectfully and follow the instructions of tour guides, coordinators, and drivers.

8.2 Misconduct
Destinato Travel and Tours reserves the right to refuse service, remove from a tour, or terminate travel arrangements without refund for any Client whose behavior:

  • Causes disruption to the group or itinerary.
  • Endangers the safety or enjoyment of others.
  • Involves illegal activities, offensive conduct, or harassment.

8.3 Responsibility for Costs
Any additional expenses incurred due to removal or termination shall be borne solely by the Client.

9. Travel Insurance

9.1 Requirement
Travel insurance is not automatically included unless explicitly stated in writing.

9.2 Recommendation
Destinato Travel and Tours strongly recommends Clients secure comprehensive travel insurance covering trip cancellation, medical emergencies, accidents, repatriation, baggage loss, and other risks.

9.3 No Liability
Failure to obtain adequate insurance shall be at the Client’s sole risk. Destinato Travel and Tours is not liable for losses that would otherwise have been covered.

10. Complaints and Dispute Resolution

10.1 Filing of Complaints
All complaints must be submitted in writing within ten (10) days of the Client’s return.

10.2 Late Complaints
Complaints received after this period will not be entertained.

10.3 Resolution Efforts
Destinato Travel and Tours will make reasonable efforts to assist with valid complaints but shall not be held liable for acts or omissions of third-party suppliers.

11. Data Privacy

11.1 Compliance
Destinato Travel and Tours complies with Republic Act No. 10173, also known as the Data Privacy Act of 2012.

11.2 Information Collected
Personal information collected (such as names, contact details, passport information, financial information, etc.) shall be used solely for processing travel bookings, visa applications, and related services.

11.3 Confidentiality
All collected personal data will be stored securely and shared only with suppliers, airlines, embassies, and payment partners as necessary to fulfill confirmed services.

11.4 Client Rights
Clients may request access to, correction, or deletion of their personal data in accordance with the Data Privacy Act.

12. Limitation of Liability

12.1 General
Destinato Travel and Tours acts only as an agent for airlines, hotels, transport companies, and local operators.

12.2 Specific Exclusions
Destinato Travel and Tours is not responsible for:

  • Loss, injury, accident, or damage to person or property.
  • Delays, cancellations, or overbooking by third-party providers.
  • Decisions made by immigration, customs, or health authorities.
  • Acts or omissions of suppliers not directly owned or operated by Destinato Travel and Tours.

12.3 Liability Cap
The maximum liability of Destinato Travel and Tours shall not exceed the amount actually paid by the Client for the services booked.

13. Governing Law and Venue

13.1 This Agreement shall be governed by and construed in accordance with the laws of the Republic of the Philippines.
13.2 Any disputes arising from or related to this Agreement shall be filed exclusively in the proper courts of Marikina City, Philippines.
